1.

Scope

These General Terms and Conditions apply to contracts for the rental and use of hotel rooms for accommodation as well as all other services and deliveries of HOLI-Berlin City Apart Hotel.

The subletting or re-renting of the rooms provided and their use for purposes other than accommodation require the prior written consent of the hotel.

The guest's general terms and conditions only apply if this has been expressly agreed in writing beforehand.

2.

Contract Formation

The accommodation contract is concluded when the hotel accepts the guest's application. The hotel is free to confirm the booking in text form.

For online bookings, the contract is concluded upon receipt of the booking confirmation by email.

The contracting parties are the hotel and the guest. If a third party has made a booking for the guest and has assumed a corresponding payment obligation towards the hotel, they are jointly and severally liable to the hotel together with the guest.

3.

Services

The hotel is obligated to keep the rooms booked by the guest available and to provide the agreed services.

The guest is obligated to pay the applicable or agreed prices of the hotel for the room rental and for the other services used.

The scope of the booked services is based on the description on our website and the booking confirmation.

Note

Special requests or requirements should be communicated at the time of booking or at the latest 24 hours before arrival.

4.

Prices and Payment

a) Prices

The stated prices are final prices and include the statutory value added tax. The current prices are shown on our website and in the booking confirmation.

b) Payment Methods

The following payment methods are accepted:

  • Cash
  • Debit card
  • Credit card (Visa, Mastercard)
  • Bank transfer (for prepayment)

c) Due Date

The total amount is due upon departure, unless prepayment or a different arrangement has been agreed.

For stays exceeding 7 nights, the hotel is entitled to issue interim invoices.

5.

Cancellation

Cancellation of the booking is possible under the following conditions:

Standard Bookings

  • Up to 48 hours before arrival: Free cancellation
  • Less than 48 hours before arrival: 100% of the first night will be charged
  • No-show: 100% of the total amount will be charged

Special Rates

For special rates or non-refundable rates, the cancellation conditions displayed at the time of booking apply.

Note

Please review and update the cancellation conditions according to your current business policy.

6.

Check-in and Check-out

Check-in

  • Check-in time: from 3:00 PM
  • Early check-in: on request and subject to availability (surcharge may apply)
  • Late arrival: Please inform us if you arrive after 10:00 PM

Check-out

  • Check-out time: until 11:00 AM
  • Late check-out: on request and subject to availability (surcharge may apply)

If the agreed check-out time is exceeded without prior arrangement, the hotel reserves the right to charge an additional day rate.

ID Requirement

According to the German Registration Act, we are required to verify the identity of our guests. Please have a valid ID card or passport ready upon arrival.

7.

House Rules

For a pleasant stay for all guests, please observe the following rules:

General Rules

  • The entire hotel is a non-smoking area
  • Quiet hours are from 10:00 PM to 7:00 AM
  • Please handle the inventory with care
  • Keys/room cards must be returned at reception upon departure

Pets

Pets are welcome by prior arrangement and for an additional fee. Please indicate when booking if you are arriving with a pet.

Damages

The guest is liable for damages caused by them, their companions, or their visitors to the hotel or its facilities.

8.

Liability

Hotel Liability

The hotel is liable for its obligations under the contract. Claims for damages by the guest are excluded unless there is intentional or grossly negligent breach of duty by the hotel, its legal representative, or vicarious agents.

Valuables

The hotel's liability for cash, securities, and valuables is limited to the statutory maximum of EUR 3,500, unless they were deposited in the hotel safe.

The hotel is only liable for items stored in the rooms in cases of proven negligence.

Lost and Found

Lost items will be sent back upon request. The storage period is 6 months.

9.

Final Provisions

Applicable Law

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws rules is excluded.

Place of Jurisdiction

The place of jurisdiction is Berlin, insofar as legally permissible.

Severability Clause

Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Consumer Dispute Resolution

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
